New Guidance on the Fair Chance Act

SUBJECT: New Guidance on the Fair Chance Act


Valued Customers:

The Interior Business Center (IBC) wanted to inform you that the Defense Counterintelligence and Security Agency (DCSA) released a new OF-306 that changed some of the language to capture the “Fair Chance Act” implementation. Guidance on the Fair Chance Act can be found here. The changes to the new OF-306 are listed below:

ADDED:

Most applicants are asked to complete this form after a tentative offer of employment has been made; however, depending on your position, you may be asked to complete this form earlier during the hiring process.”

REPLACED:

You may be asked to complete this form at any time during the hiring process.”

Recently, OPM SuitEA announced the publication of the 2023 version of the Optional Form (OF306) and this form is available at https://www.opm.gov/forms/optional-forms/ .

DCSA will begin accepting the 2023 version of the OF306 with investigative submissions on 11/1/2023. To remain compliant, IBC will no longer accept the 2019 OF-306 version after Monday, December 18, 2023.

Please provide a copy of the “Revised August 2023” OF-306 (version located in bottom right corner of form) after this date. It’s also acceptable to submit this form with security packets starting immediately. IBC will accept and process both versions up until the cut-off date.
